The future of tech regulation and the metaverse: outlook from the US

Digital in-conversation with Conan D’Arcy, TMT Senior Practice Director, Global Counsel, and Tom Wheeler, former Chairman of the U.S. Federal Communications Commission during the Obama Administration and current CEO of the Shiloh Group, a telecommunications investment firm, discussing the future of tech regulation and the metaverse.

They discussed:

  • The implications of the recent Supreme Court West Virginia v. EPA ruling on the regulatory powers of federal agencies. We will plan to discuss a range of issues such as the future of the FCC, Title II designations, and existing initiatives such as the FTC’s progress on a new data privacy rulemaking.

  • The outlook for broader tech regulation, including a potential digital regulator and prospects for current proposed legislation regarding data privacy and competition, such as the ADPPA and the American Innovation and Choice Online Act.

  • The outlook for the metaverse – and how the opportunities it presents will differ from those of the current internet.

  • The geopolitical dynamics between Europe and the US on global tech regulation and whether forums like the Transatlantic Technology Council will propel joint rule making across the Atlantic given recent divergences in regulation.
